CASE UPDATE: Orange County agent arrested in $1.6 million fraud scheme targeting elderly Mark Malatesta, 55, of San Clemente pleaded guilty today to 23 felony counts. In conjunction with his guilty plea, Malatesta was sentenced to five years of formal probation. Additionally Malatesta paid a total of $281,959 in restitution, $110,075 to his elderly victims and $171,884 to the insurance company. Malatesta is no longer allowed to work in the finance or insurance industry. The Department of Insurance revoked Malatesta's insurance license effective April 26, 2018.

Brian Jared Smart, 41, a former life insurance agent, pleaded guilty to a dozen felony counts of theft after stealing over $1.8 million from at least five elderly clients. Smart was sentenced to 15 years in state prison and ordered to pay $1,810,508 in restitution to his victims. More information on this case and other CDI investigations: https://bit.ly/2ywIXQD

Insurance Commissioner Dave Jones announced today that four bills he sponsored to strengthen consumer protections for wildfire survivors have passed the Senate Insurance Committee with unanimous, bipartisan votes. These bills authored by Assemblymember Cecilia Aguiar-Curry and Assemblymember Marc Levine aim to address critical issues facing wildfire survivors including underinsurance, rebuilding, and recovery. Erwin Raul Mejia, 42, of Van Nuys, was sentenced to 10 years in state prison following his conviction on 10 felony counts of insurance fraud for his role in a staged auto collision ring that bilked insurers out of more than $700,000. Mejia was also ordered to pay $699,784 in restitution to six auto insurers. 25 additional arrests were made in connection with this organized ring, which in total has resulted in $1.7 million in losses to insurers. The department’s investigation is ongoing and more arrests are likely to follow. The Los Angeles County District Attorney's Office is prosecuting this case. More info: http://bit.ly/2LQfVgv

Lodi doctor indicted in $700,000 insurance fraud scheme. Dr. Gary Royce Wisner, 61, of Lodi, is scheduled for arraignment today at 1:30 p.m. in Department 8B at the San Joaquin County Superior Court on 11 felony counts of insurance fraud for bilking insurers out of more than $700,000 for allegedly providing unnecessary and excessive medical treatment for orthopedic patients. Insurance Commissioner Dave Jones announced today he has approved the first Cannabis Business Owners Policy (CannaBOP) in the State of California. The American Association of Insurance Services (AAIS) designed the new CannaBOP program for cannabis dispensaries, storage facilities, processors, manufacturers, distributors, and other cannabis-related businesses operating in the state.
