From the Desk of Sheriff Bobby J. Guidroz ‘Did You Know’ September 18, 2018 HUMAN TRAFFICKING “THE MODERN SLAVERY” Part 5 of 6 There are many myths related to human and labor trafficking. I hope this helps you identify and gives you a better understanding. The more knowledge we have the better, we can stop it. Here are a few myths on labor trafficking. They chose to be here – Remember, Human Trafficking and Smuggling are very different. Human Trafficking carries the element of force, fraud, or coercion. People who have been smuggled into the U.S. may be here by choice, but Human Trafficking victims are not. They are all here illegally - Less than 30 percent of immigrants in the U.S. are undocumented. Victims can only be foreign nationals or immigrants from other countries – The federal definition of Human Trafficking includes both U.S. citizens and foreign nationals. Both are protected under the Federal trafficking statutes and have been since the Victims of Trafficking and Protection Act (TVPA) of 2000. Human Trafficking within the United States affects victims who are U.S. citizens, lawful permanent residents, visa holders, and undocumented workers. There must be elements of physical restraint, force, or bondage when identifying a trafficking situation - The legal definition of trafficking does not require physical restraint, bodily harm, or physical force. Psychological means of control, such as threats or abuse of the legal process, are sufficient elements of the crime. Unlike the previous Federal involuntary servitude statutes (U.S.C. 1584), the new Federal crimes created by the Trafficking Victims Protection Act (TVPA) of 2000 were intended to address “subtler” forms of coercion and to broaden previous standards that only considered bodily harm. If they don’t like it they can leave - The nature of Human Trafficking (force, fraud, or coercion) means they cannot safely leave their situation. Our next and final part will give you the myths of sex trafficking and the conclusion of our Human Trafficking series.

ESCAPED INMATE CAUGHT According to Sheriff Bobby J. Guidroz, the inmate that walked off a work detail on September 7, has been captured in the Eunice area. Once it was learned that a trusty working at the departments service station left the grounds, the sheriff’s office along with area agencies began an extensive search. The department worked leads from Eunice to Baton Rouge but one very observant citizen spotted him in the Eunice area and notified the sheriff’s office. Deputies responded to the area where the inmate was spotted and arrested him without incident. Sheriff Guidroz would like to thank all the agencies, media, and citizens who assisted in the capture of the inmate.

From the Desk of Sheriff Bobby J. Guidroz ‘Did You Know’ September 11, 2018 HUMAN TRAFFICKING “THE MODERN SLAVERY” Part 4 of 6 There are different types of trafficking. Sex trafficking is also driven by buyer demand. Whether a pimp is involved or not, anyone under the age of 18 is deemed a victim of sex trafficking when they engage in commercial sex with an adult. The buyer is viewed as the perpetrator any time the victim is a minor. Sex trafficking can be: Pimp-controlled or Gang-controlled. Pimp-controlled - Victims are controlled by individual pimps who often force victims to use drugs, or Gang-controlled - Victims are controlled by a collection of individuals, gangs, organized crime, or syndicates. Violence and intimidation are typically used to force cooperation. Sex trafficking involves commercial sexual exploitation, such as prostitution, pornography, bride trafficking, military prostitution, and sex tourism. According to studies, prostitution accounts for the largest amount of forced labor that occurs in the United States. The commercial sexual exploitation of women and children has ties to prostitution, pornography, and exotic dancing. Forms of labor-driven trafficking are: Bonded labor or debt peonage - Victims become bonded laborers when their labor is demanded as a means of repayment for a loan or service. Bonded labor or debt peonage began in plantation economies where employers forced workers to buy from employer-run stores at inflated prices so they could never pay off the debt. Today, we see this when employers force victims to live on-site, charge them inflated rent, pay low or no wages, and don’t allow them to leave. Forced labor - Victims are forced to work against their will under threat of violence or other form of punishment. Freedom is restricted and a degree of ownership is exerted. Child labor - The International Labor Organization estimates 215 million children between the ages of 5 and 17 are involved in child labor. The commercial sex trade, forced military service, drug trade, domestic servitude, construction, manufacturing, and illegal arms trade are all areas in which children are forced into labor trafficking. The agricultural sector also experiences a high occurrence of forced labor, particularly seasonal farm workers, such as citrus pickers. Farm workers are particularly vulnerable because agricultural working conditions are generally poor, wages are low, legal protections for agricultural workers are weak, and there is little monitoring of working conditions. Common employers of victims are agricultural and landscape work, factory work, food service, construction, carnivals, hotel housekeeping, day labor, nail salons, and domestic servitude or childcare. The human traffickers use multiple methods to control their victims. Without control the victims would simply just walk away. The goal of the traffickers is to use all means necessary to control and keep the victims in their “stable”. Common tactics include, beatings, rapes, starvation, isolation, and psychological abuse. Traffickers also use drug/alcohol dependency, document withholding, debt bondage, threats of deportation, family threats, and confinement. In the next series we will discuss some myths of Human Trafficking.
