SHAWN M. MITSTIFER, 22 years of age, of Montour Falls, N.Y., pleaded guilty in Schuyler County Court on November 1, 2018 to Endangering the Welfare of a Child, a Class A Misdemeanor. Mitstifer was sentenced to 9 months incarceration, fined and an Order of Protection was issued for the victim. ANDREW BUTTON, 33 years of age, of Odessa, N.Y., pleaded guilty in Schuyler County Court on November 1, 2018 to Attempted Criminal Possession of a Controlled Substance in the Second Degree, a Class B Felony. Button was sentenced to 2.5 years incarceration with 1.5 years post release supervision. MATTHEW R. SCHERING, 49 years of age, of Lexington, Kentucky, pleaded guilty in Schuyler County Court on November 1, 2018 to Driving While Intoxicated, a Class E Felony. Schering was sentenced to a 3 year conditional discharge and fined $5,000.00. BRIAN J. HARTZELL, 26 years of age, of Odessa, N.Y., pleaded guilty in Schuyler County Court on August 23, 2018 to Reckless Endangerment in the First Degree, a Class D Felony. Hartzell was sentenced on November 1, 2018 to 5 years probation, and an Order of Protection was issued for the victim. BRUCE R. COREY, 52 years of age, of Burdett, N.Y., pleaded guilty in Schuyler County Court on November 1, 2018 to Criminal Possession of a Controlled Substance in the Fifth Degree and Unlawful Manufacture of Methamphetamine in the Third Degree, Class D Felonies. Corey is scheduled to be sentenced on January 17, 2019. WILLIAM A. SCHOEBERLEIN, JR., 43 years of age, of Baltimore, Maryland, pleaded guilty in Schuyler County Court on November 1, 2018 to Assault in the Second Degree, a Class D Felony. Schoeberlein is scheduled to be sentenced on January 17, 2019.

On behalf of the Schuyler County District Attorney’s Office, I wish to extend our condolences to Trooper Nicholas Clark’s family. We are all deeply saddened by the loss of one of our finest, young troopers. It was a vicious, cowardly and senseless act that took his life at such a young age. It is a reminder to us all that our officers are in danger every day as they serve to protect our communities and families. It is a reminder that this kind of tragedy can happen anywhere at any time. I would also like to commend the Steuben County Sheriff’s Deputy Josh Day, who was by Trooper Clark’s side when this tragedy struck. Our thoughts and prayers are with the New York State Police, the Steuben County Sheriff’s Department, and all other men and women in blue who risk their lives to protect us every day. ~ DA Fazzary

AVERY J. WELLES, 35 years of age, of Rome P.A., pleaded guilty in Schuyler County Court on March 1, 2018 to Attempted Possession of a Sexual Performance by a Child, a Class A Misdemeanor. Wells is scheduled to be sentenced in April of 2018, to the maximum sentence of one year of jail. JAMES J. SHORTT, 21 years of age, of Millport, N.Y., pleaded guilty in Schuyler County Court on January 18, 2018, to Attempted Criminal Possession of a Controlled Substance in the Third Degree, a Class C Felony. Shortt was sentenced on March 1, 2018 to 2 years in state prison, plus 1 year post release supervision. The case involved Shortt possessing several packages of heroin with the intent to sell. DANIEL E. DECKER, 53 years of age, of Montour Falls, N.Y., pleaded guilty in Schuyler County Court on December 21, 2017 to Criminal Possession of a Controlled Substance in the Second Degree, a Class A-II Felony. Decker was sentenced on March 1, 2018 as a second felony offender to 5.5 years in state prison, plus 5 years post release supervision and is ordered to pay restitution in the amount of $9,134.38, joint and several with his co-defendants. The case stems from the discovery of a methamphetamine lab at his apartment at Romeo Village in the Village of Montour Falls. That methamphetamine lab was discovered after one of his codefendant’s left his apartment with a different methamphetamine lab which then exploded as those contents were being taken out of the building. DALE J. HAZEN, 36 years of age, of Watkins Glen, N.Y., pleaded guilty in the Hector Town Court of Schuyler County on December 20, 2017 to Sexual Misconduct, a Class A Misdemeanor. Hazen was sentenced on February 28, 2018, to a conditional discharge and is required to register as a Sex Offender.
